How do you know if a design or trademark is registered?
Design or trademark registration can be confirmed by searching the respective database maintained by e.g. the United States Patent and Trademark Office (USPTO), EU Intellectual Property Office (EUIPO) or World Intellectual Property Organization (WIPO). A registered design or trademark will have a registration number and be published in the relevant registry. The design or trademark should be graphically and not descriptively represented to be suitable for registration. A letter of disclosure may have been sent to the brand owner upon registration.
